Mxolisi Adolphus Myambo

MANAGING PARTNER

Mxolisi Adolphus Myambo, LLB, is the Managing Partner and is admitted as an Attorney in the High Court of South Africa. He commenced with his articles of clerkship in January 2007 and after completion, was appointed as a Professional Assistant from 7 January 2009, thus an Attorney with 19 years’ experience. He was subsequently appointed into the partnership with effect of 1 February 2012 and has served as the Managing Partner in the Firm with effect of 1 June 2018.
Mr Myambo is primarily involved in the public administrative law sphere with particular emphasis on municipal administrative law litigation, forensic investigations in respect of misconduct and disciplinary proceedings against councillors and employees and dealing with all labour related matters stemming therefrom, including prosecuting and/or chairing disciplinary hearings, appeal hearings and further dispute proceedings in the CCMA, Bargaining Councils and Labour Court.

Dr Anton Deon De Swardt

PARTNER

B.Com (Law) LLB LLD, is a Partner who is admitted as an Attorney, Notary and Conveyancer and holds the Right of Appearance in the High Court of South Africa. He was a founding member of the Firm in 1996. Dr De Swardt has been practicing as an Attorney from February 1994, thus an Attorney with 32 years’ experience.
Dr De Swardt is primarily involved in public administrative and commercial law litigation. Litigation work is conducted primarily in the Constitutional Court, the Supreme Court of Appeal, the different divisions of the High Court throughout the Republic of South Africa and the Labour Appeal Court and Labour Court within the public and administrative law sphere. Specialist municipal administrative law work includes in particular High Court interdicts relating to constitutional challenges and the validity of municipal council resolutions and general administrative acts, as well as the valuation of property within municipal jurisdictions for municipal rating purposes.

Fransisca Shai

Francisca Isabella Chuene Shai

Mrs Shai is an admitted Attorney of the High Court of South Africa with extensive experience in labour law, public administrative law, and workplace governance. She specialises in conducting workplace investigations, disciplinary hearings, grievance proceedings, arbitrations, and employment-related litigation.

She regularly advises and represents clients in matters involving employee misconduct, disciplinary processes, labour disputes, unfair dismissals, and compliance with labour legislation. Her experience extends to appearing in various dispute resolution forums, including the CCMA, Bargaining Councils, Labour Court, Labour Appeal Court, and other tribunals.

Mrs Shai is known for her strategic approach, professionalism, and ability to handle sensitive workplace matters with fairness, efficiency, and integrity. She has assisted both public and private sector clients, particularly within the local government sphere, in navigating complex employment and governance issues.

Tshepo Hlahla : National Certificate: Municipal Financial Management LLB, is a Partner and has been admitted and practising as an Attorney in the High Court of South Africa since 25 January 2018. Mr Hlahla is primarily involved in the commercial, corporate, and public administrative law litigation sphere in the Firm.

Areas of expertise and success:

Mr. Hlahla, has overseen the following matters in these areas: 

1.Corporate and Commercial Law

Successfully defended business rescue proceedings, representing the MEC for Transport in the North West from the High Court to the Constitutional Court overseeing the matter of T.H SAMONS  v Member of the Executive Council for the Department of Community Safety and Transport Management, North West.

2. Public Procurement Law

  • Successfully defended organs of state procurement decisions in high court. 
  • Performed probity role on numerous public procurement  project on behalf of organs of state. 
  • Is currently completing his Masters in Public Procurement Policy and Regulation at Stellenbosch University (final year).

2. Constitutional and Administrative Law

  • He was  intimately involved with Atamelang bus transport (PTY) LTD (in business rescue) v Member of the Executive Council for the Department of Community Safety and Transport Management, North West : A matter at the intersection of constitutional law and contract law, centering on the application of section 18(3) of the Superior Courts Act, exploring the tension between the constitutional rights of the public and other competing interests.
  • He has overseen Sizani Ma Zulu Transport (pty) ltd v Member of the Executive Council for the Department of Community Safety and Transport Management, North West : A matter dealing with the review processes into administrative decisions of a state entity. 

3. Labour Law

  • Has conducted numerous investigations into high-profile employment-related misconduct.
  • Manages labour disputes from initiation (disciplinary hearings) through the CCMA or Bargaining Council, and up to the Labour Court.

4. Local and Provincial Government

  • Intimately involved in the development and legislative drafting of municipal bylaws and policies for various municipalities across the country.
  • Conducted investigations within both local and provincial government spheres, covering constitutional, administrative, labour, and public procurement law.
